Reservation and Cancellation Policy
This Reservation and Cancellation Policy (hereinafter the “Policy“) of Livin Barca, LDA, with registered office at Estrada Nacional 327, no. 320, 3870-304 Torreira, Murtosa, Aveiro, NIPC 515296538 (hereinafter “Livin Barca“), regulates, in particular, reservations/bookings and cancellations of accommodation and nautical activities by the client (hereinafter the “Client” or “Clients“).
This Policy is complemented by and integrates the Privacy Policy, Cookies Policy and Terms of Use (available here, here and here, respectively) in everything that is not provided for in this document.
Acceptance of the Reservation and Cancellation Policy
The Client acknowledges that any reservations/bookings and cancellations made with Livin Barca, including any associated payments, are subject to the terms of this Policy, which are expressly accepted.
About Reservations/Bookings
Types of Activities and Reservations/Bookings
Livin Barca offers a wide range of experiences grouped into two categories: (i) accommodation and (ii) nautical activities (more information here). These experiences can be reserved/booked online or directly with Livin Barca.
Online reservations/bookings
Online reservations/bookings are made via the Livin Barca website here.
Direct reservations/bookings
Direct reservations/bookings can be made through an agency, by telephone and/or email. For more information, please contact Livin Barca using the contact details below.
Terms of Payment and Guarantee
Online reservations/bookings
On the Livin Barca website, you’ll find up-to-date information on the activities available and their prices. In addition to the price of the activity, there is an online reservation/booking fee, duly identified next to the price.
Online reservations/bookings are subject to the association of Credit Card details to be provided when filling in the reservation/booking form and the presentation of ID or equivalent at the time of check-in.
The total amount will be charged at the time of reservation/booking and will be confirmed once payment has been successfully processed, except for activities that require confirmation of availability (namely SUP Tour, Boat Trip and Boat Trip & Oyster Tasting), which will be confirmed to the Client using the contact details provided by the Client to Livin Barca.
Direct reservations/bookings
If you make a direct reservation/booking, having confirmed the type of activity, date and time, an e-mail will be sent to the address you have provided Livin Barca with the terms of payment.
Direct reservations/bookings are subject to a charge of 50%t of the total amount at the time of reservation/booking (as a condition of completion of the reservation/booking), 50% at the time of check-in + a deposit of €250 at the time of check-in (deposit not applicable in the case of nautical activities).
The reservation/booking request is available 24 hours after payment of the amount to be paid (50% of the total amount).
Arrival and Departure
Check-in: 4pm / Check-out: 10am
Late check-in, late check-out: On request, subject to confirmation of availability. Please contact Livin Barca using the contact details below.
Babies / Children
It is possible to place one cot per household, free of charge. If you wish, please contact Livin Barca using the contact details below. There are no extra beds.
Pets
Pets are not allowed on the property.
Terms of Use and Useful Information
Without prejudice to these and other rules foreseen in the information booklet that will be made available to the Client the day before check-in via the contact details that they have provided to Livin Barca and at the accommodation, if applicable, the Client is hereby informed of the following:
- Only the people listed on the reservation/booking will be entitled to take part in the activity(ies), which includes accommodation (where applicable);
- In the case of accommodation, we inform you that the capacity of the house is limited – this information is duly clarified at the time of reservation/booking. Any increase in capacity is subject to prior approval by Livin Barca. In the event of more people arriving than the capacity of the house without prior notice, we reserve the right not to accept the check-in and not to refund any amount paid up to the date;
- The Client must treat other Clients with consideration and respect Livin Barca’s rules;
- The Client must treat Livin Barca and its facilities and equipment with care and consideration;
- The central courtyard and the garden are shared spaces, so Clients should leave them as they found them;
- Clients are limited to the areas designated for their use, and the family’s private areas on the property are restricted and not authorised for access;
- Clients may not use the Ria pier (intended exclusively for nautical activities) for sunbathing or other purposes;
- Access to the Ria pier is only authorised for nautical activities;
- Children must be supervised by an adult Client at all times within the Livin Barca property;
- Smoking is not allowed inside the property or in the gardens. Cigarettes may not be thrown on the ground. Guests can smoke in the designated areas, namely on the private decks where ashtrays are provided;
- If a consequence of negligent use, theft or even damage to an object is detected, an amount proportional to the negligent use/theft/damage will be withheld;
- Any defects that the Client identifies (in the equipment, accommodation, etc.) must be reported to Livin Barca as soon as the Client becomes aware of them.
Liability and Guarantees
Livin Barca accepts no liability in the event of theft, loss or damage to valuables such as money, jewellery or other objects of considerable value on Livin Barca property, including inside vehicles.
Livin Barca shall only be liable for the Client’s damages or losses when such facts result from its culpable actions.
All nautical activity Clients are covered by personal accident insurance.
Cancellations of reservations/bookings
Cancellation due to Force Majeure
Any reservation/booking may be cancelled due to incidents beyond Livin Barca’s control, such as natural disasters, natural calamities, pandemics, war, government orders or the impossibility of using the facilities for other reasons. In particular, the reservation/booking of nautical activities will always be conditioned by the suitability of the weather conditions and may be cancelled at any time if the forecasts or weather conditions are unfavourable and with potential direct implications for the life and/or safety of the Client and/or Livin Barca employees (for example, in the event of rain or strong winds).
In these cases, the cancellation will be promptly notified to the Client using the contact details provided by the Client to Livin Barca. The Client has the right to be refunded for all sums paid up to the time of cancellation, or alternatively reschedule under the terms of this Policy.
Cancellation by the Client and Refund Conditions
The Client may cancel reservations/bookings with prior notice to the e-mail address info@livinbarca.com , provided that:
- In the case of online reservation/booking of accommodation,
- If the cancellation is made at least 21 days before the date of the reservation/booking, it will be free of charge and the total amount paid will be refunded, with the possibility to alternatively reschedule under the terms of this Policy;
- If the Client cancels less than 21 days before the reservation/booking date, the full amount will be charged, with no right to reschedule under the terms of this Policy.
- In the case of direct reservation/booking of accommodation (through an agency, by telephone or e-mail):
- If the Client cancels at least 30 days before the date of the reservation/booking, Livin Barca will not refund the amount paid up to the date of cancellation (50% of the reservation/booking amount), leaving the Client with this amount in credit to use for one year, during which time they can use it under the terms of the rescheduling section of this Policy;
- If the Client cancels less than 30 days before the reservation/booking date, the Client will not be entitled to a refund of any sums paid up to the time of cancellation (50% of the reservation/booking amount) and will not be entitled to rescheduling under the terms of this Policy.
- In the case of online reservation/booking of nautical activities:
- If the cancellation is made at least 8 days before the date of the reservation/booking, the total amount paid will be refunded, and rescheduling is also possible under the terms of this Policy;
- If the Client cancels less than 8 days before the date of the reservation/booking, the full amount will be charged, without being entitled to rescheduling under the terms of this Policy.
- In the case of direct reservation/booking of nautical activities (through an agency, by telephone or e-mail):
- If the Client cancels at least 8 days before the date of the reservation/booking, the total amount paid (50% of the reservation/booking amount) will be refunded, and rescheduling is also possible under the terms of this Policy.
- If the Client cancels less than 8 days before the reservation/booking date, the Client will not be entitled to a refund of any sums paid up to the time of cancellation (50% of the reservation/booking amount) and will not be entitled to rescheduling under the terms of this Policy.
No-show at the Reservation/Booking without Prior Notice by the Client
Failure to turn up on the day and at the time scheduled in the reservation/booking without prior notice will result in no refund of any amount paid to date as compensation. The Client also does not have the possibility of rescheduling under the terms of this Policy
Exceptionally, in cases of duly justified and proven with a medical certificate injury or unexpected illness that makes attendance impossible, or in the event of compliance with legal obligations, including appearance before police or judicial authorities, Livin Barca, in good faith but at its sole discretion, may not apply the provisions of the previous paragraph.
Cancellation or Rescheduling by Livin Barca
Any reservation/booking may be cancelled by Livin Barca at any time, with immediate effect. This cancellation will be promptly notified to the Client using the contact details provided by the Client to Livin Barca.
In these cases, the Client has the right to be refunded for all sums paid up to the time of cancellation, or alternatively to reschedule under the terms of this Policy.
Rescheduling of the Reservation/Booking
Should the Client so prefer, there is the possibility of rescheduling the reservation/booking under the terms set out in this Policy, namely in the event of (i) cancellation of the reservation/booking for reasons of force majeure; (ii) cancellation with observance of the minimum foreseen prior notice; or (iii) cancellation by Livin Barca.
Rescheduling is subject to availability. Should you want to reschedule, you can choose to reserve/book the same activity or another one, accepting that the respective prices may vary (for example, if you book in Winter and cancel, the number of days you can enjoy in Summer will be lower because the rate is more expensive). In addition, the Client may choose to book another activity at a higher price, having to pay the difference, or at a lower price, in which case Livin Barca will not refund the difference.
In the event that part of the reservation/booking amount has been charged prior to the date, namely in cases of direct reservation/booking cancellation, Livin Barca will not refund the amount paid, leaving the Client with this amount in credit to use for one year, with payment of the remainder being made at the time of check-in on the new date following the rescheduling. After the expiry of the one-year period, it will not be possible to reschedule under the terms of this Policy, nor will the Client be entitled to a refund of any sums paid.
Other provisions
Changes to the Reservation and Cancellation Policy
Livin Barca reserves the right, at any time, without prior notice and with immediate effect, to alter, add to, update or delete, in whole or in part, this Cancellation and Refund Policy.
Therefore, the Client should periodically check the Terms of Use to confirm whether any updates or changes have been made.
Processing of Personal Data
Livin Barca, as the data controller, processes the Client’s personal data collected in the context of the reservation/booking for the purposes of managing the reservation/booking and/or any cancellations. The personal data will be processed on the basis of the relationship established with the Client through the reservation/booking and will be kept for the period strictly necessary to fulfil the purposes for which they were collected.
Livin Barca may transfer the personal data collected for the purposes mentioned above to other entities for the provision of certain services since it may involve access to your personal data by these entities. Therefore, any subcontractor of Livin Barca will process the personal data collected on behalf of Livin Barca, following our instructions and in accordance with the subcontracting agreement celebrated with those entities.
The Client’s data may also be disclosed to third parties when such disclosure is deemed necessary or appropriate (i) in light of applicable law, (ii) in compliance with legal obligations/court orders, (iii) following decisions or rulings by supervisory authorities, or (iv) in response to requests from public or government authorities.
In any of the above situations, Livin Barca will take all appropriate measures to ensure the effective protection of personal data.
The Client may exercise their rights of access, rectification, erasure, restriction, objection to processing and portability at any time, provided that the legal requirements for admissibility are met. Without prejudice to any other administrative or judicial remedy, the Client has the right to lodge a complaint with the competent supervisory authority under the terms of the law (in Portugal, the National Data Protection Commission – “CNPD”) if they believe that the processing of their data by Livin Barca violates the legal regime in force at any given time.
